REGULAR MEETING

 

            The Fairbank City Council met in Regular Session on Monday, June 9, 2008.  Mayor Welsh called the meeting to order with the Pledge of Allegiance at 6:00 P.M.  Members present:  Shields, Kayser, Woods and Frost.  Absent: Mangrich.  Also present: B. J. Sackett, Police Chief; Ted Vorwald, Utility Superintendent; Gary Ott, Maintenance Technician; Heather Prendergast, City Attorney; Dave Ryan, Assistant Public Works Director and Marlene Strempke, City Clerk.

            Motion by Frost, second by Woods to approve the agenda as presented.  Roll call vote—Ayes: Frost. Woods, Kayser and Shields.  Nays: None.

            Motion by Kayser, second by Woods to approve the Minutes of the May 19th Regular Meeting.  Roll call vote—Ayes: Kayser, Woods, Shields and Frost.  Nays: None.

            Motion by Shields, second by Kayser to approve the Treasurer’s Report.  Receipts for the month of May 2008 were $216,849.98 and disbursements were $136,619.01.  Balance on hand at close of business on May 31, 2008 was $1,458,666.14.  Roll call vote—Ayes: Shields, Kayser, Frost and Woods.  Nays: None.

            Motion by Shields, second by Woods to hold the second reading of ORDINANCE 309 – AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF FAIRBANK, IOWA, BY AMENDING SECTION 92.02 RATES FOR SERVICE.  Roll call vote—Ayes: Shields, Woods, Kayser, Frost.  Nays: None.

            Motion by Frost, second by Kayser to hold the second reading of ORDINANCE 310 – AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF FAIRBANK, IOWA, BY AMENDING SECTION 106.08, SECTION 1, COLLECTION FEES.  Roll call vote—Ayes: Frost, Kayser, Woods and Shields.  Nays: None.

            Motion by Kayser, second by Shields to approve Cigarette Permit renewals for Fairbank Food Center, Casey’s General Store and Pronto Market.  Roll call vote—Ayes: Kayser. Shields, Frost and Woods.  Nays: None.

            Motion by Frost, second by Woods to approve RESOLUTION 2008-10 – RESOLUTION CERTIFYING UNPAID UTILITY OBLIGATIONS FOR COLLECTION.  Roll call vote—Ayes: Frost, Woods, Shields and Kayser.  Nays: None.

            Motion by Kayser, second by Shields to approve the reappointment of Bob Bellis to a five year term on the Board of Adjustment.  Roll call vote—Ayes: Kayser, Shields, Frost and Woods.  Nays: None.

            Motion by Shields, second by Frost to approve the reappointment of Sharon Woods to a five year term on the Planning and Zoning Commission.  Roll call vote—Ayes: Shields, Frost, Kayser and Woods.  Nays: None.

            According to information from the bonding attorney, the Council can amend the current Urban Renewal Plan to declare the use of funds from TIF taxes for geo-thermal at the school is for economic development.  The council is interesting in doing something to promote the school, but not necessarily TIF.

            The Cedar Rapids DOT office will be conducting a speed check and traffic study on all the main routes into town.  Truck routes will be discussed again once the results are available.

            Approval of Application of Beer License was delayed until Councilman Mangrich could get here.

            Motion by Shields, second by Frost to approve the request to the Iowa Department of Transportation to approve the closing of Main Street for Fairbank Days.  Roll call vote—Ayes: Shields, Frost, Kayser and Woods.  Nays: None.

            Motion by Woods, second by Frost to extend the closing time for any park designated for Fairbank Days activities until 2:00 A.M. during the Fairbank Days Celebration.  Roll call vote—Ayes: Woods, Frost, Kayser and Shields.  Nays: None.

            Motion by Kayser, second by Shields to participate in the Change a Light, Change the World Program again this year.  Roll call vote—Ayes: Kayser, Shields, Woods and Frost.  Nays: None.

            Ted has been talking to the residents along West Main about replacing the sidewalk.  Motion by Kayser, second by Shields to replace the entire sidewalk on the north side of the street between Walnut Street and North Washington Street with the property owners paying for any portion that was not damaged during the construction process.  Roll call vote—Ayes: Kayser, Shields, Woods and Frost.  Nays: None.

            Councilman Mangrich arrived at 6:45 P.M.

            Motion by Shields, second by Mangrich to approve the Application for Beer License for Fairbank Development Corporation.  Roll call vote—Ayes: Shields, Mangrich and Frost.  Nays: None.  Abstain: Woods and Kayser.

            Councilman Mangrich left the meeting at 6:52 P.M.

            Motion by Shields, second by Woods to purchase the gas lawn mower from Knapp’s at a base price of $9,031.  Roll call vote—Ayes: Shields, Woods, Kayser and Frost.  Nays: None.

            Motion by Kayser, second by Shields to form a Mayor’s Commission to seek funding and grants to remove sand from around the island and have a timeline for accomplishing this to the Council by January 2009.  Roll call vote—Ayes: Kayser, Shields, Frost and Woods.  Nays: None.

            Motion by Woods. second by Frost to approve Change Order 1, Division 1 to Dolan Excavating, LLC for a decrease of $66.  Roll call vote—Ayes: Woods, Frost, Kayser and Shields.  Nays: None.

            Motion by Shields, second by Kayser to approve Change Order 1, Division 2 to Dolan Construction, LLC for and increase of $6,603.65.  Roll call vote—Ayes: Shields, Kayser, Woods and Frost.  Nays: None.

            Motion by Frost, second by Shields to approve Payment Request 3 from Dolan Construction, LLC in the amount of $121,783.41.  Roll call vote—Ayes: Frost, Shields, Woods and Kayser.  Nays: None.

            Motion by Kayser, second by Frost to extend the deadline for completion of the Highway 281 Utility Improvements Project to June 23, 2003 at 5:00 P.M.  Roll call vote—Ayes: Kayser, Frost, Shields and Woods.  Nays: None.

            Motion by Shields, second by Kayser to give 3% salary increases to the following: all salaried employees with the exception of the police chief; part-time police officers and seasonal employees and to offer Drake Mangrich a beginning salary of $25,000.  Roll call vote—Ayes: Shields, Kayser, Woods and Frost.  Nays: None.

            Motion by Woods, second by Kayser to pay the bills as presented with an adjustment to Butler County REC to actual when received.  Roll call vote—Ayes; Woods, Kayser, Frost and Shields.  Nays: None.
