REGULAR MEETING

The Fairbank City Council met in Regular Session on Monday, December 11,
2006.  Mayor Welsh called the meeting to order at 6:00 P.M.  Members
present: Frost, Shields, Mangrich, Kayser and Woods.  Also present:  B.J.
Sackett, Police Chief; Gary Ott, Maintenance Technician; Carter Stevens,
City Attorney and Marlene Strempke, City Clerk.
Motion by Frost, second by Mangrich to approve the agenda as presented.
Roll call vote-Ayes:  Frost, Mangrich, Kayser, Woods and Shields.  Nays:
None.
Motion by Kayser, second by Woods to approve the Minutes of the November
27th Regular Meeting and the December 4th Special Meeting.  Roll call
vote-Ayes: Kayser, Woods, Shields, Frost and Mangrich.  Nays: None.
Motion by Mangrich, second by Kayser to accept the Treasurer's Report.
Receipts for November were $178,350.17 and disbursements were $119,316.95.
 Balance on hand at close of business on November 30, 2006 was
$1,534,957.29.Roll call vote-Ayes: Mangrich, Kayser, Woods, Shields and
Frost.  Nays: None.
Motion by Frost, second by Woods to open the Public Hearing on the
Development Agreement with Fairbank Development Corp.  Roll call
vote-Ayes: Frost, Woods, Kayser, Mangrich, and Shields.  Nays: None. Mick
Kane explained the terms of the agreement.
Motion by Mangrich second by Shields to close the Public Hearing.  Roll
call vote-Ayes: Mangrich, Shields, Woods, Kayser and Frost.  Nays: None.
Motion by Shields, second by Frost to approve RESOLUTION 2006-33 -
APPROVING DEVELOPMENT AGREEMENT WITH FAIRBANK DEVELOPMENT CORPORATION
AUTHORIZING TAX INCREMENT PAYMENTS AND PLEDGING CERTAIN TAX INCREMENT
REVENUES TO THE PAYMENT OF THE AGREEMENT.  Roll call vote-Ayes: Shields,
Frost and Mangrich.  Abstain: Kayser and Woods.  Nays: None.
Motion by Kayser, second by Woods to open the Public Hearing for the
FY2007 Budget Amendment.  Roll call vote-Ayes: Kayser, Woods, Shields,
Frost and Mangrich.  Nays: None. No comments written or oral were
received.
Motion by Mangrich, second by Frost to close the Public Hearing.  Roll
call vote-Ayes: Mangrich, Frost, Shields, Woods and Kayser.  Nays: None.
Motion by Woods, second by Frost to approve RESOLUTION 2006-34 - CITY
BUDGET AMENDMENT AND CERTIFICATION RESOLUTION.  Roll call vote-Ayes:
Woods, Frost, Mangrich, Kayser and Shields.  Nays: None.
Motion by Frost, second by Kayser to open the Public Hearing for
Telecommunication Easement with Midwest Wireless Iowa L.L.C. Roll call
vote-Ayes: Frost, Kayser, Woods, Shields and Mangrich.  Nays: None.
Attorney Stevens addressed the changes he requested and Curt Walter
representing Midwest Wireless said his company had no problem with the
changes.  Councilman Kayser requested that a light be placed on top of the
tower and Mr. Walter agreed.
Motion by Shields, second by Mangrich to close the Public Hearing.  Roll
call vote-Ayes: Shields, Mangrich, Kayser, Woods and Frost.  Nays: None.
Motion by Kayser, second by Mangrich to approve RESOLUTION 2006-35 - A
RESOLUTION AUTHORIZING THE MAYOR TO ENTER INTO A TELECOMMUNICATION
EASEMENT WITH MIDWEST WIRELESS IOWAL.L.C.  Roll call vote-Ayes: Kayser,
Mangrich, Frost, Shields and Woods.  Nays: None.
Craig Codner and Bobby Joe Miller from Butler County REC handed out a
spreadsheet for the estimated cost of power for the coming year and the
comparisons with the past year.  The information will be used when the FY
2008 budget is prepared.
Motion by Woods, second by Shields to repay the $3,500.00 loan to INRCOG
for the purchase of the property at 204 Fourth Street South from the Low
Income Project Checking Account.  Roll call vote-Ayes: Woods, Shields,
Frost, Mangrich and Kayser.  Nays: None.
Motion by Mangrich, second by Frost to approve RESOLUTION 2006-36 -
RESOLUTION AUTHORIZING TRANSFER OF FUNDS.  Roll call vote-Ayes: Mangrich,
Frost, Shields, Woods and Kayser.  Nays: None.
Motion by Mangrich, second by Frost to pay the bills as presented with
the correction to Butler County REC bill for the actual amount rather
than the estimated amount included in the bill listing.  Roll call
vote-Ayes: Mangrich, Frost, Shields, Woods and Kayser.  Nays: None.
