REGULAR MEETING

 

                The Fairbank City Council met in Regular Session on Monday, September 10, 2007.  Mayor Welsh called the meeting to order at 6:00 P.M.  Members present: Shields, Woods, Frost, Kayser and Mangrich.  Also present: Ted Vorwald, Utility Superintendent; B. J. Sackett, Police Chief; Carter Stevens, City Attorney and Marlene Strempke, City Clerk.

                Motion by Shields, second by Mangrich to amend the agenda to include Payment of Bills.  Roll call vote—Ayes Shields, Mangrich, Kayser, Woods and Frost.  Nays: None.

                Motion by Frost, second by Kayser to approve the agenda as amended.  Roll call vote—Ayes: Frost, Kayser, Woods, Shields and Mangrich.  Nays: None.

                Motion by Woods, second by Mangrich to approve the Minutes of the August 27, 2007 Regular Meeting.  Roll call vote—Ayes: Woods, Mangrich, Frost, Shields and Kayser.  Nays: None.

                Motion by Kayser, second by Shields to approve the Treasurer’s Report.  Receipts for the month of August were $121,199.23 and disbursements were $139,588.53.  Balance on hand at close of business on August 31, 2007 was $1,470,792.67.  Roll call vote—Ayes: Kayser, Shields, Frost, Mangrich and Woods.  Nays: None.

                Motion by Frost, second by Mangrich to open the Public Hearing on Hwy 281 Utility Improvement Projects.  Roll call vote—Ayes: Frost, Mangrich, Kayser, Woods and Shields.  Nays: None.

                Jon Biederman from TeKippe Engineering was present and went over the plans and drawings of the project.  Bids will be opened on September 20th and will be acted upon at the September 24th council meeting.  Completion date is June 2008.  No other comments written or oral were received.

                Motion by Mangrich, second by Woods to close the Public Hearing.  Roll call  vote—Ayes: Mangrich, Woods, Shields, Frost and Kayser.  Nays: None.

                Motion by Mangrich, second by Shields to approve RESOLUTION 2007-12 – RESOLUTION TO ACCEPT THE PRELIMINARY AND FINAL PLAT OF FAIRBANK DEVELOPMENT CORPORATION INDUSTRIAL PARK, CITY OF FAIRBANK, IOWA.  Roll call vote—Ayes: Mangrich, Shields, Woods, Kayser and Frost.  Nays: None.

                Attorney Stevens explained the legal procedures that will occur in dealing with issues at 308 Fourth Street South.

                The issue of ways to collect unpaid fines was addressed by Attorney Stevens.

                There has been no response from the school on the stop signs.  Councilman Mangrich stated he would talk to Superintendent Peterson about the matter.

                Ted presented a couple of options for the street lights on Collins Road.  Motion by Shields, second by Kayser to go with the galvanized steel pipe option at a cost of $$3,170.48.  Roll call vote—Ayes: Shields, Kayser, Mangrich, Frost and Woods.  Nays: None.

                Motion by Mangrich, second by Frost to schedule City Clean Up Day for Thursday, October 11, 2007.  Roll call vote—Mangrich, Frost, Shields, Woods and Kayser.  Nays: None.  Pick up will begin at 7:00 A.M.  Tags for appliances and electronics will be available at city hall at a cost of $15.00 per item and need to be purchased in advance of pick up.

                Motion by Kayser, second by Mangrich to pay the bills as presented with the adjustment of the Butler County REC bill to actual when received.  Roll call vote—Ayes: Kayser, Mangrich, Frost, Shields and Woods.  Nays: None.
