REGULAR MEETING

The Fairbank City Council met in Regular Session on Monday, January 12, 2004. Mayor Welsh called the meeting to order at 6:00 P.M. Members present: Kayser, Suckow, Frost and Woods. Absent: Plaster. Also present: Ted Vorwald, Utility Superintendent; Mary Lou Fink, City Treasurer; Clarence Leyh, Police Chief and Marlene Strempke, City Clerk.

Motion by Kayser, second by Woods to amend the agenda to include Fire Department Annual Report. Roll call vote—Ayes: Kayser, Woods, Suckow and Frost. Nays: None.

Motion by Frost, second by Suckow to approve the agenda as amended. Roll call vote—Ayes: Frost, Suckow Kayser and Woods.

Motion by Kayser, second by Suckow to approve the Minutes of the December 8th and 22nd, 2003 Regular Meetings. Roll call vote—Ayes: Kayser, Suckow, Frost and Woods. Nays: None.

Motion by Suckow, second by Woods to accept the December Treasurer’s Report. Roll call vote—Ayes: Suckow, Woods, Kayser and Frost. Receipts for the month of December were $262,192.92 and disbursements were $296,396.00. Balance on hand at close of business on December 31, 2003 was $1,313,447.41.

Tom and Ben Schaffer of USAquatics were present to discuss progress on pool construction. One funbrella and the slide have been ordered. Everything is going well and should meet the projected completion date.

Motion by Suckow, second by Kayser to hold the second reading and waive the third reading of ORDINANCE 283—AN ORDINANCE AMENDING THE CODE OF ORDINANCES FOR THE CITY OF FAIRBANK, IOWA, PERTAINING TO YIELD SIGNS. Roll call vote—Ayes: Suckow, Kayser, Woods and Frost. Nays: None.

Motion by Kayser, second by Woods to approve ORDINANCE 283—AN ORDINANCE AMENDING THE CODE OF ORDINANCES FOR THE CITY OF FAIRBANK, IOWA, PERTAINING TO YIELD SIGNS. Roll call vote—Ayes: Kayser, Woods, Suckow and Frost. Nays: None.

A Petition for Voluntary Annexation was presented to the council by Woods Construction, Inc. and John and Sharon Woods. Motion by Kayser, second by Suckow to approve RESOLUTION 2004-01—RESOLUTION APPROVING ANNEXATION OF REAL ESTATE. Roll call vote—Ayes: Kayser, Suckow and Frost. Nays: None. Abstain: Woods.

Motion by Suckow, second by Frost to approve RESOLUTION 2004-02—A RESOLUTION OF THE FAIRBANK CITY COUNCIL APPROVING PLAT subject to filing sufficient security to insure completion of the project. Roll call vote—Ayes: Suckow, Frost and Kayser. Nays: None. Abstain: Woods.

By July 1, 2004 the rock base, asphalt, intakes, curb and gutter and topsoil must be completed.

Motion by Suckow, second by Frost to appoint Mary Lou Fink as City Treasurer and Marlene Strempke as City Clerk. Roll call vote—Ayes: Suckow, Frost, Kayser and Woods. Nays: None. Mayor Welsh then administered the oath of office to the appointees.

Motion by Kayser, second by Suckow to approve the application for liquor license renewal for Fairbank American Legion Post. Roll call vote—Ayes: Kayser, Suckow, Woods and Frost. Nays: None.

A decision on donated park benches was tabled.

There will be no changes on garbage collection policies at this time.

The Fire Department will furnish a fire extinguisher for the police car at a cost of $35.00.

A budget work session is scheduled for Tuesday, January 20, 2004 at 5:30 P.M.
