REGULAR MEETING
The Fairbank City Council met in Regular Session on Monday, April 14, 2008. Mayor Welsh called the meeting to order at 6:00 P.M. Members present: Mangrich, Woods, Frost and Kayser. Absent: Shields. Also present: B.J. Sackett, Police Chief; Ted Vorwald, Utility Superintendent; Dave Ryan, Assistant Public Works Director; Heather Prendergast, City Attorney; Gary Ott, Maintenance Technician and Marlene Strempke, City Clerk.
Motion by Frost, second by Mangrich to approve the agenda as presented. Roll call vote—Ayes: Frost, Mangrich, Kayser and Woods. Nays: None.
Motion by Kayser, second by Woods to approve the Minutes of the March 24th Regular Meeting. Roll call vote—Ayes: Kayser, Woods, Frost and Mangrich. Nays: None.
Motion by Mangrich, second by Kayser to approve Treasurer’s Report. Receipts for the month of March were $219,456.90 and disbursements were $212,234.62. Balance on hand at close of business on March 31, 2008 was $1,232,400.38. Roll call vote—Ayes: Mangrich, Kayser, Woods and Frost. Nays: None.
Councilman Shields arrived at 6:02 P.M.
Denise Youngblut and Kevin Kaufman were present to discuss their application for liquor license renewal. Motion by Shields to ask Costa’s Sports Bar & Grill to supply a copy of Iowa Criminal History Record from DCI before the city council will consider the application for license renewal. Motion died for lack of a second. Attorney Prendergast said she would call the Alcohol and Beverage Division and report on information she received on liquor licensing and criminal background checks. Motion by Mangrich, second by Shields to table action on the application until the next meeting when the information will be available. Roll call vote—Ayes: Mangrich, Shields, Kayser and Frost. Nays: Woods.
Motion by Woods, second by Mangrich to hold the first reading of Ordinance No. 160.03. Roll call vote—Ayes: Woods, Mangrich, Frost, Shields and Kayser. Nays: None.
Motion by Kayser, second by Mangrich to waive the second and third readings and to approve ORDINANCE NO. 160.03 – AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF FAIRBANK , IOWA, BY AMENDING CHAPTER 160.03. Roll call vote—Ayes: Kayser, Mangrich, Frost, Shields and Woods. Nays: None.
Motion by Kayser, second by Shields to approve RESOLUTION 2008-05 – A RESOLUTION SETTING FAIR MARKET VALUES FOR PURPOSE OF FEMA RELATED DISASTERS. Roll call vote—Ayes: Kayser, Shields, Frost, Mangrich and Woods. Nays: None.
Motion by Shields, second by Mangrich to proceed with placing a lien on a property for non-payment of utilities. Roll call vote—Ayes: Shields, Mangrich, Kayser, Woods and Frost. Nays: None.
Councilman Shields would like to have traffic slowed on Grove Street from Fourth Street East. Will need to check with the state to find the regulations to see if it is possible since it is a state highway.
Councilman Woods left at 7:00 P.M.
Motion by Shields, second by Mangrich that the City purchase the Iowa Municipal Policy Leaders Handbook for each of the council members. Roll call vote—Ayes: Shields, Mangrich, Kayser and Frost. Nays: None.
Motion by Mangrich, second by Kayser to purchase a flag for the council chambers and to begin each council meeting with the pledge of allegiance. Roll call vote—Ayes: Mangrich, Kayser, Shields and Frost. Nays: None.
Motion by Mangrich, second by Shields to approve Payment One to Dolan Excavating, LLC for $45,555.05 for the water portion and $3,477.00 for the storm sewer portion of the utility improvements on West Main Street. Roll call vote—Ayes: Mangrich, Shields, Kayser and Frost. Nays: None.
Motion by Kayser, second by Mangrich to approve the bills as presented. Roll call vote—Ayes: Kayser, Mangrich, Frost and Shields. Nays: None.
