REGULAR MEETING
The Fairbank City Council met in Regular Session on Monday, August 14, 2006. Mayor Welsh called the meeting to order at 6:00 P.M. Members present: Shields, Frost, Woods, Kayser and Mangrich. Also present: B. J. Sackett, Police Chief; Ted Vorwald, Utility Superintendent; Dave Ryan, Assistant Public Works Director and Marlene Strempke, City Clerk.
The individual who had asked to have item 14 on the agenda could not be present and asked that it be moved to the next meeting. Motion by Frost, second by Woods to adopt the agenda with that exception. Roll call vote—Ayes: Frost, Woods, Mangrich, Shields and Kayser. Nays: None.
Motion by Shields, second by Mangrich to approve the Minutes of the July 24, 2006 Regular Meeting. Roll call vote—Ayes: Shields, Mangrich, Woods, Frost and Kayser. Nays: None.
Motion by Woods, second by Kayser to approve the July Treasurer’s Report. Receipts for July were $145,620.52 and disbursements were $151,479.29. Balance on hand at the close of business on July 31, 2006 was $1,348,010.27. Roll call vote—Ayes: Woods, Kayser, Mangrich, Frost and Shields. Nays: None.
Motion by Mangrich, second by Frost to open the Public Hearing on the Fairbank Comprehensive Land Use Plan at 6:05 P.M. Roll call vote—Ayes: Mangrich, Frost, Shields, Woods and Kayser. Nays: None. No written comments were received. After discussion, it was decided to change one parcel on the west edge of town from R-1 to C-1 and to increase the area designated as C-1 on the north edge of town to accommodate the buildings already there. Anna Mae Wolfgram was present to ask if any of the areas could be changed in the future. Brian Schoon of INRCOG commented that it could be possible if the correct procedures were followed.
Motion by Frost, second by Mangrich to close the Public Hearing. Roll call vote—Ayes: Frost, Mangrich, Kayser, Woods and Shields. Nays: None.
Motion by Woods, second by Kayser to adopt RESOLUTION 2006-18 – A RESOLUTION TO ADOPT THE FAIRBANK COMPREHENSIVE LAND USE PLAN as amended. Roll call vote—Ayes: Woods, Kayser, Mangrich, Frost and Shields. Nays: None.
Motion by Kayser, second by Frost to open the Public Hearing on the Zoning Ordinance. Roll call vote—Ayes: Kayser, Frost, Shields, Woods and Mangrich. Nays: None. No written comments were received and no further oral comments were made. The Zoning Ordinance will be amended to correspond with the changes in the comprehensive land use plan.
Motion by Shields, second by Mangrich to close the Public Hearing. Roll call vote—Ayes: Shields, Mangrich, Kayser, Woods and Frost. Nays: None.
Motion by Mangrich, second by Woods to approve the first reading of ORDINANCE 296 – ZONING ORDINANCE as amended. Roll call vote—Ayes: Mangrich, Woods, Shields, Frost and Kayser. Nays: None.
Dean Brase, Library Board President, was present to request that $10,000 of the money that is in the Library Hi-Fi account be put into a one year CD at Fairbank State Bank at a rate of 5.35%. Motion by Shields, second by Woods to approve the transfer. Roll call vote—Ayes: Shields, Woods, Kayser, Mangrich and Frost. Nays: None.
There have been complaints on the increased truck traffic not obeying traffic laws. Chief Sackett was directed to step up enforcement and write more tickets instead of just verbal warnings.
Motion by Mangrich, second by Frost to approve RESOLUTION 2006-19 – RESOLUTION TO APPROVE CITY ENGINEER TO REQUEST BIDS REGARDING SERVICES IN THE PROPOSED INDUSTRIAL PARK. Roll call vote—Ayes: Mangrich, Frost, and Shields. Nays: None. Abstain: Woods and Kayser.
Motion by Frost, second by Mangrich to approve RESOLUTION 2006-20 – RESOLUTION TO APPROVE CITY ENGINEER TO AUTHORIZE BIDS REGARDING SERVICES IN THE PROPOSED INDUSTRIAL PARK ON A PROPOSED DATE. Bids will be received until 4:00 P.M. on August 28 and will be opened at 6:05 P.M. at the council meeting. Roll call vote—Ayes: Frost, Mangrich, and Shields. Nays: None. Abstain: Kayser and Woods.
The Weed Control ordinance was discussed. It was decided to amend the ordinance to set the civil penalty for non-compliance at $25.00 per week and if the city has to do the mowing the rate would be $50.00 per hour with a one-hour minimum charge. Motion by Kayser, second by Mangrich to approve the first reading of ORDINANCE 297 – WEED CONTROL as amended. Roll call vote—Ayes: Kayser, Mangrich, Frost and Woods. Nays: Shields.
Motion by Shields, second by Woods to approve RESOLUTION 2006-21 – RESOLUTION APPROVING FY 2006 ANNUAL ROAD USE TAX REPORT. Roll call vote—Ayes: Shields, Woods, Kayser, Mangrich and Frost. Nays: None.
Motion by Kayser, second by Mangrich to approve the first reading of ORDINANCE 298 – AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF FAIRBANK, IOWA, BY ADDITION OF A NEW SECTION PERTAINING TO TEMPORARY ROLL OUT STOP SIGNS AT INTERSECTIONS. Roll out signs will be placed at the intersections of Grove Street and Fifth Street South and Forest Street and Fourth Street North for the safety of children on their way to school. Roll call vote—Ayes: Kayser, Mangrich, Frost, Shields and Woods. Nays: None.
Motion by Mangrich, second by Woods to waive the second and third readings and approve the ordinance. Roll call vote—Ayes: Mangrich, Woods, Kayser, Frost and Shields. Nays: None.
Vacating non-used alleys was tabled for now.
No action was taken on the electric service territory until we see how much interest there is from other utilities.
Independence has asked for support from other cities in the county to ask that RAGBRAI consider a route across the county. The Mayor will get more information.
Motion by Mangrich, second by Kayser to approve the renewal of the employee health insurance as proposed by United Healthcare. Roll call vote—Ayes: Mangrich, Kayser, Woods, Shields and Frost. Nays: None.
Motion by Shields, second by Woods to approve the closing of Rainbow Drive on August 24th from 5:00 P.M. to12 A.M. for a neighborhood picnic. Roll call vote—Ayes: Shields, Woods, Kayser, Mangrich and Frost. Nays: None.
