REGULAR MEETING
The Fairbank City of Fairbank Council met in Regular Session on Monday, November 14, 2005. Mayor Welsh called the meeting to order at 6:00 P.M. Members present: Frost, Shields, and Plaster. Absent: Kayser and Woods. Also present: B. J. Sackett, Police Chief; Jim Peters, City Attorney; Gary Ott, Maintenance; Ted Vorwald, Utility Superintendent; Ed Gipper, Fire Chief; Dave Ryan, Assistant Public Works Director and Marlene Strempke, City Clerk.
Motion by Frost, second by Plaster to approve the agenda as presented. Roll call vote—Ayes: Frost, Plaster and Shields. Nays: None.
Motion by Shields, second by Frost to approve the Minutes of the October 24th Regular Meeting. Roll call vote—Ayes: Shields, Frost and Plaster. Nays: None.
Motion by Frost, second by Plaster to approve the Treasurer’s Report. Receipts for the month of October were $209,731.54 and disbursements were $102,533.43. Balance on hand at the close of business on October 31, 2005 was $1,113,021.57. Roll call vote—Ayes: Frost, Plaster and Shields. Nays: None.
Motion by Shields, second by Frost to open the Public Hearing on the 2005 Urban Renewal Area Designation and Plan. Roll call vote—Ayes: Shields, Frost and Plaster. Nays: None. No one present had any comment and no written statements or evidence was received.
Motion by Plaster, second by Shields to close the Public Hearing. Roll call vote—Ayes: Plaster, Shields, and Frost. Nays: None.
Motion by Frost, second by Plaster to approve RESOLUTION 2005–20–A RESOLUTION TO DECLARE NECESSITY AND ESTABLISH AN URBAN RENEWAL AREA, PURSUANT TO SECTION 403.4 OF THE CODE OF IOWA AND APPROVE URBAN RENEWAL PLAN AMENDMENT FOR THE 2005 ADDITION TO THE FAIRBANK URBAN RENEWAL AREA. Roll call vote—Ayes: Frost, Plaster, and Shields. Nays: None.
Council member Frost introduced an ordinance entitled “Ordinance No. 292. An Ordinance providing for the division of taxes levied on taxable property in the 2005 Addition to the Fairbank Urban Renewal Area of the City of Fairbank, Iowa, pursuant to Section 403.19 of the Code of Iowa.
Motion by Plaster, second by Shields that the aforementioned ordinance be adopted. Roll call vote—Ayes: Plaster, Shields and Frost. Nays: None.
Motion by Frost, second by Plaster to waive the second and third readings of Ordinance No. 292. Roll call vote—Ayes: Frost, Plaster and Shields. Nays: None.
Motion by Shields, second by Frost for the final passage and adoption of ORDINANCE NO. 292—AN ORDINANCE PROVIDING FOR THE DIVISION OF TAXES LEVIED ON TAXABLE PROPERTY IN THE 2005 ADDITION TO THE FAIRBANK URBAN RENEWAL AREA OF THE CITY OF FAIRBANK, IOWA, PURSUANT TO SECTION 403.19 OF THE CODE OF IOWA. Roll call vote—Ayes: Shields, Frost and Plaster. Nays: None.
Bob Baumann of Butler County REC presented price estimates for the feeder to get electric from the new Alliant substation into Fairbank. The information will be taken under consideration.
Councilman Woods arrived at 6:14 P.M.
No one was present to give information on the Don Steggall Industrial Park so it will be on a later agenda.
Motion by Woods, second by Frost to approve RESOLUTION 2005-21—RESOLUTION CERTIFYING TIF DEBT. Roll call vote—Ayes: Woods, Frost Plaster and Shields. Nays: None.
Motion by Plaster, second by Shields to hold the second reading and waive the third reading of ORDINACE NO. 291—AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF FAIRBANK, IOWA, PERTAINING TO STOP SIGNS. Roll call vote—Ayes: Plaster, Shields, Frost and Woods. Nays: None.
Motion by Woods, second by Frost to approve the Mutual Aid Agreement with Covenant Health System, Inc. Roll call vote—Ayes: Woods, Frost, Shields and Plaster. Nays: None.
Ed Gipper, Brian Stark and Ben Wolff had information on vehicle replacement for the fire department. They estimate it will take anywhere from $120,000 to $185,000 for the replacement with a used vehicle and $225,000 for a new vehicle. The next month will be used to look for options for both the city and the fire department as far as financing such a purchase.
Attorney Peters will take the present draft of the City Driving Policy and clean up some of the wording and add a provision pertaining to alcohol and driving.
The Iowa Code will be purchased on CD for the police department.
Burning of leaves and grass was discussed. A mailer will be sent out next spring asking residents to use the city compost site if at all possible. If burning continues to be an issue, some sort of regulation will be looked at.
