REGULAR MEETING

 

                The Fairbank City Council met in Regular Session on Monday, July 23, 2007.  Mayor Welsh called the meeting to order at 6:00 P.M.  Members present: Shields, Woods, Frost, Mangrich and Kayser.  Also present: B. J. Sackett, Police Chief; Mike Athey, Police Officer; Dave Ryan, Assistant Public Works Director; Gary Ott, Maintenance Technician; Ted Vorwald, Utility Superintendent and Marlene Strempke, City Clerk.

                Motion by Kayser, second by Frost to amend the agenda to include Closing of First Street North for RAGBRAI.  Roll call vote—Ayes: Kayser, Frost, Shields, Woods and Mangrich.  Nays: None.

                Motion by Frost, second by Woods to approve the agenda as amended.  Roll call vote—Ayes: Frost, Woods, Kayser, Mangrich and Shields.  Nays: None.

                Motion by Woods, second by Mangrich to approve the Minutes of the July 9, 2007 Regular Meeting.  Roll call vote—Ayes: Woods, Mangrich, Frost, Shields and Kayser.  Nays: None.

                Several people were present to voice concerns about the truck traffic through town.  Jack Duffy and Bud Ferguson felt that the driving habit of the truckers were no worse than the general population.  John & Deb Yonkovic expressed concerns about trucks making the turns at the corner of Grove Street and Fourth.  Rick VanDaele gave the truckers point of view on the situation.  A representative of Hawkeye Renewables was present to listen to concerns.  The speed of trucks coming in from the north was one of the major concerns and added law enforcement was suggested.  The situation will be studied and put on the next agenda.

                Motion by Mangrich, second by Kayser to approve a temporary 30 day permit for an outdoor beer garden for Cost’s Sports Bar and Grill until a plan for a permanent fence is submitted to the council. At that time, it may be made permanent.  Roll call vote—Ayes: Mangrich, Kayser, Woods, Shields and Frost.  Nays: None.

                Motion by Kayser, second by Mangrich to hold the second reading , waive the third reading and approve ORDINANCE 305 – AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF FAIRBANK, IOWA, BY ADDITION OF A NEW SECTION PERTAINING TO EXCESSIVE NOISE AND AMENDING THE FINES.  Roll call vote—Ayes: Kayser, Mangrich, Frost, Shields and Woods.  Nays: None.

                Motion by Woods, second by Frost to approve RESOLUTION 2007-09 – RESOLUTION TO RECOGNIZE THE FAYETTE COUNTY LOCAL HOUSING TRUST FUND.  Roll call vote—Ayes: Woods, Frost, Mangrich, Kayser and Shields.  Nays: None.

                Motion by Shields, second by Mangrich to pay the additional security needed for RAGBRAI as contract labor from the police department budget.  Roll call vote—Ayes: Shields, Mangrich and Frost.  Nays: None. Abstain: Kayser and Woods.

                The weed ordinance will be put on the next agenda to get further clarification from the attorney. 

                Motion by Mangrich, second by Frost to approve RESOLUTION 2007-10 –  RESOLUTION FOR COLLECTION OF RATES AND CHARGES PURSUANT TO CODE OF IOWA CHAPTER 384.84.  Roll call vote—Ayes: Mangrich, Frost, Shields, Woods and Kayser.  Nays: None.

                Motion by Mangrich, second by Woods to close First Street North on Thursday July 26 while RAGBRAI is in town.  Roll call vote—Ayes: Mangrich, Woods, Shields, Frost and Kayser.  Nays: None.

                Motion by Mangrich, second by Kayser to adjourn at 7:05 P.M.  Roll call vote—Ayes: Mangrich, Kayser, Woods, Shields and Frost.  Nays: None.
