REGULAR MEETING

 

            The Fairbank City Council met in Regular Session on Monday, June 23, 2008.  Mayor Welsh called the meeting to order at 6:00 P.M. with the Pledge of Allegiance.  Members present:  Frost, Mangrich, Kayser, Shields and Woods.  Also present: B. J. Sackett, Police Chief; Ted Vorwald, Utility Superintendent; Gary Ott, Maintenance Technician and Marlene Strempke, City Clerk.

            Motion by Woods, second by Frost to approve the agenda as presented.  Roll call vote—Ayes: Woods, Frost, Mangrich, Kayser and Shields.  Nays: None.

            Motion by Shields, second by Mangrich to approve the Minutes of the June 9th Regular Meeting.  Roll call vote—Ayes: Shields, Mangrich, Kayser, Woods and Frost.  Nays: None.

            Motion by Mangrich, second by Frost to hold the third and final reading of Ordinance 309 – Rates for Water Service.  Roll call vote—Ayes: Mangrich, Frost, Shields, Woods and Kayser.  Nays: None.

            Motion by Kayser, second by Shields to pass and approve ORDINANCE 309 – AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF FAIRBANK, IOWA, BY AMENDING SECTION 92.02 RATES FOR SERVICE.  Roll call vote—Ayes: Kayser, Shields, Frost, Mangrich and Woods.  Nays: None.

            Motion by Woods, second by Kayser to hold the third and final reading of Ordinance 310 – Collection Fees for Garbage.  Roll call vote—Ayes: Woods, Kayser, Mangrich, Frost and Shields.  Nays: None.

            Motion by Mangrich, second by Kayser to pass and approve ORDINANCE 310 – AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF FAIRBANK, IOWA, BY AMENDING SECTION 106.08, SECTION 1, COLLECTION FEES.  Roll call vote—Ayes: Mangrich, Kayser, Woods, Shields and Frost.  Nays: None.

            Motion by Woods, second by Mangrich to approve the purchase of the bullet proof vest required for Reserve Officer Chris Molyneux which is to be reimbursed by Iowa Vocational Rehabilitation Services.  Roll call vote—Ayes: Woods, Mangrich, Frost, Shields and Kayser.  Nays: None.

            The City of Fairbank has received a request to sponsor Chris Molyneux to attend the Iowa Law Enforcement Academy from September 8, 2008 to October 31, 2008.  The Iowa Vocational Rehabilitation Services will be covering all costs for this schooling.  Motion by Kayser, second by Mangrich to sponsor the reserve officer going to the academy pending the successful completion of a background check and a letter drafted by the city attorney reaffirming that there will be no costs to the city and waiver of city liability.  After completing the Academy, Mr. Molyneux will be hired by the City of Fairbank.  Roll call vote—Ayes: Kayser, Mangrich, Frost, Shields and Woods.  Nays: None.

            Sump pumps emptying into the sanitary sewer has been a serious problem during the heavy rains.  City ordinance states that sump pumps are to empty outside or into a storm sewer.  A letter will be sent to all residents informing them of the requirements and asking everyone that does not have a sump pump and pit to install one.  The first efforts of compliance will be in three areas, Rainbow Drive, Lakeside Drive and West Main Street.  Motion by Shields, second by Kayser to begin enforcing the Ordinance currently on the books regarding sump pumps.  Roll call vote—Ayes: Shields, Kayser, Mangrich, Frost and Woods.  Nays: None.

            Motion by Shields, second by Mangrich to start the process of purchasing the property where the new storm sewer intake is located.  Roll call vote—Ayes: Shields, Mangrich, Kayser, Woods and Frost.  Nays: None.

            Motion by Frost, second by Shields to approve RESOLUTION 2008-10 – RESOLUTION ESTABLISHING EMPLOYEES SALARIES with the exception of  (g) which will be reviewed in six months and the raise paid retroactively to July 1 if job performance is satisfactory.  Roll call vote—Ayes: Frost, Shields, Woods and Mangrich.  Nays: Kayser.

            Motion by Shields, second by Mangrich to approve RESOLUTION 2008-11 – RESOLUTION AUTHORIZING TRANSFER OF FUNDS.  Roll call vote—Ayes: Shields, Mangrich, Kayser, Woods and Frost.  Nays: None.

            Motion by Kayser, second by Woods to pay the bills as presented.  Roll call vote—Ayes: Kayser, Woods, Shields, Frost and Mangrich.  Nays: None.
