REGULAR MEETING
The Fairbank City Council met in Regular Session on Monday, May 8, 2006. Mayor Welsh called the meeting to order at 6:00 P.M. Members present: Kayser, Frost, Mangrich, Woods and Shields. Also present: Carter Stevens, City Attorney; B. J. Sackett, Police Chief; Ted Vorwald, Utility Superintendent; Dave Ryan, Assistant Public Works Director and Marlene Strempke, City Clerk.
Motion by Mangrich, second by Frost to amend the agenda to include Pool. Roll call vote—Ayes: Mangrich, Frost, Shields, Woods and Kayser. Nays: None.
Motion by Frost, second by Mangrich to approve the agenda as amended. Roll call vote—Ayes: Frost, Mangrich, Kayser, Woods and Shields. Nays: None.
Motion by Kayser, second by Shields to approve the Minutes of the April 10th and 24th Regular Meetings. Roll call vote—Ayes: Kayser, Shields, Frost, Mangrich and Woods. Nays: None.
Motion by Shields, second by Frost to approve the Treasurer’s Report for April. Receipts for the month of April were $250,973.47 and disbursements were $126,117.84. Balance on hand at close of business on April 30, 2006 was $1,278,311.75. Roll call vote—Ayes: Shields, Frost, Mangrich, Kayser and Woods. Nays: None.
Motion by Woods, second by Kayser to open the Public Hearing to Dispose of Real Estate at 6:05 P.M. Roll call vote—Ayes: Woods, Kayser, Mangrich, Frost and Shields. Nays: None. Attorney Stevens announced that the necessary work on the title and abstract were done and the city could now dispose of the property. There is a possibility that the house cannot be burned because of the close proximity to pine trees so it will be sold as is. No objections or comments, written or oral, were received.
Motion by Mangrich, second by Frost to close the Public Hearing. Roll call vote—Ayes: Mangrich, Frost, Shields, Woods and Kayser. Nays: None.
Motion by Mangrich, second by Frost to approve RESOLUTION 2006-12 – RESOLUTION TO SELL LOT 4, BLOCK 8 IN THE ORIGINAL PLAT OF FAIRBANK, BUCHANAN COUNTY, IOWA.
Roll call vote—Ayes: Mangrich, Frost, Shields, Woods and Kayser. Nays: None.
Motion by Frost, second by Shields to open the Public Hearing on the FY06 budget amendment. Roll call vote—Ayes: Frost, Shields, Woods, Kayser and Mangrich. Nays None. No public comments, written or oral were received.
Motion by Kayser, second by Mangrich to close the Public Hearing. Roll call vote—Ayes: Kayser, Mangrich, Frost, Shields and Woods. Nays: None.
Motion by Woods, second by Mangrich to approve RESOLUTION 2006-13 – RESOLUTION AMENDING THE CURRENT BUDGET FOR FISCAL YEAR ENDING JUNE 30, 2006. Roll call vote—Ayes: Woods, Mangrich, Kayser, Shields and Frost. Nays: None.
Motion by Kayser, second by Frost to approve the Mayor signing the Electric Service Contract with Butler County REC for service beginning August 1, 2006. Roll call vote—Ayes: Kayser, Frost, Shields, Woods and Mangrich. Nays: None.
Motion by Woods, second by Kayser to send a letter stipulating the acceptance of Alliant Energy’s rate correction filing. Roll call vote—Ayes: Woods, Kayser, Mangrich and Frost. Nays: Shields.
Discussion was held on doing a sex offender ordinance. Attorney Stevens will contact some professionals who deal with sex offenders and ask them to attend the next council meeting to address the issue of public awareness of sex offenders and their behavior.
Motion by Shields, second by Mangrich to approve the Application for a Liquor License for Fairbank Development Corporation for Fairbank Days. Roll call vote—Ayes: Shields, Mangrich, Woods and Frost. Nays: None. Abstain: Kayser.
Main Street will only be closed for the parade on Saturday of Fairbank Days so state permission is not required.
Motion by Kayser, second by Woods to approve the Mayor’s appointment of the following people to the Board of Adjustment—Bob Bellis, Brad Welsh, Jamie Risse, John Friedrich and Jean Wolff. Roll call vote—Ayes: Kayser, Woods, Shields, Frost and Mangrich. Nays: None.
Motion by Woods, second by Mangrich to pay the bills as presented and to add Prendergast Law Office for $150.00 and Scheel’s All Sport for $390.40. Roll call vote—Ayes: Woods, Mangrich, Frost, Shields and Kayser. Nays: None.
