REGULAR MEETING

 

The Fairbank City Council met in Regular Session on Monday, May 9, 2005.  Mayor Welsh called the meeting to order art 6:00 P.M.  Members present: Kayser, Shields, Frost and Plaster.  Absent: Woods.  Also present: Ted Vorwald, Utility Superintendent; Dave Ryan, Assistant Public Works Director; B. J. Sackett, Police Chief; Jim Peters, City Attorney; Gary Ott, Utility Worker; Ed Gipper Fire Chief and Marlene Strempke, City Clerk.

Motion by Plaster, second by Shields to approve the agenda as presented.  Roll call vote—Ayes: Plaster, Shields, Frost and Kayser, Nays: None.

Motion by Kayser, second by Frost to approve the Minutes of the April 11th and 25th Regular Meetings.  Roll call vote—Ayes: Kayser, Frost, Shields and Plaster.  Nays: None.

Motion by Frost, second by Kayser to accept the Treasurer’s Report for the month of April.  Receipts for April were $229,198.67 and disbursements were $108,353.34.  Balance on hand at the close of business on April 30, 2005 was $1,062,910.59.  Roll call vote—Ayes: Frost, Kayser, Plaster and Shields.  Nays: None.

Councilman Woods arrived at 6:06 P.M.

Fire Chief Ed Gipper introduced five new firefighters and/or EMTS who have completed probation and have joined the department.

Residents on Grove Street and other residents were present to express their views on curb and gutter on the street to address a serious water problem each time it rains.  Residents who were for the project and were willing to pay 100% of the cost as well as those who thought the city should pay the entire cost were heard.  Motion by Kayser, second by Woods to have the City Attorney draw up papers which would split the cost twenty (20) percent to the city and eighty (80) percent to the property owner.  This amount could be put on taxes over a ten (10) year period at five (5) percent interest.  Roll call vote—Ayes: Kayser, Woods and Shields.  Nays: Frost and Plaster.  The street committee will meet with property owners after the paperwork is received from the attorney.

Use of streets and alleys in the Higby Addition will be on the next agenda giving council members time to look at the situation.

The city crew completed one mailbox and figured it will cost approximately $150.00 per mailbox to bring up to code.  Letters will be sent to everyone not in compliance asking them to correct the situation.  Motion by Shields, second by Kayser to have the City Attorney write an opinion if the city can do it and legally charge the cost to the resident.  Roll call vote—Ayes: Shields, Kayser, Woods, Frost and Plaster.  Nays: None.

Motion by Shields, second by Frost to approve the Application for Liquor License for Fairbank Development, Inc. in conjunction with Fairbank Island Days.  Roll call vote—Ayes: Shields, Frost, Plaster and Woods. Nays: None.  Abstain: Kayser.

Motion by Frost, second by Plaster to approve the Fireworks Permit for Fairbank Island Days.  Roll call vote—Ayes: Frost, Plaster, Woods and Shields.  Nays: None. Abstain: Kayser.

Teen dance concessions will be handled by the Police Committee.

Motion by Kayser, second by Frost to replace eight sections of sidewalk from the post office east at a cost of $768.00.  Roll call vote—Ayes: Kayser, Frost, Plaster, Shields and Woods.  Nays: None.

Light bar for the police car will be handled by the Police Committee.

Motion by Woods, second by Kayser to approve RESOLUTION 2005-12 – RESOLUTION AMENDING AUTHORIZED AMOUNT FOR INVESTMENT IN CERTAIN DEPOSITORIES.  Roll call vote—Ayes: Woods, Kayser, Plaster, Frost and Shields.  Nays: None.

Motion by Woods, second by Shields to invest transfers for fire truck and police car in hi-fi account.  Roll call vote—Ayes: Woods, Shields, Frost, Plaster and Kayser.  Nays: None.

Motion by Kayser, second by Frost to begin the procedure to certify water, sewer and garbage rates to property taxes.  Roll call vote—Ayes: Kayser, Frost, Plaster, Shields and Woods.  Nays: None.

Motion by Shields, second by Plaster to approve the bills as presented and add Kayser Screen Printing for $1,868.75, B & K Automotive for $470.80, Haven Electronics for $149.89, Qwest for $37.67 and USAquatics for $5,895.69.  Roll call vote—Ayes: Shields, Plaster, Frost, Woods and Kayser.  Nays: None.
